| On January 18, 2000, Governor Whitman signed the Local Public Contract Law, Chapter 440 of the Laws of 1999, which took effect April 17, 2000. The law raises the bid threshold, and provides an exemption from the bid threshold for libraries and schools pursuing purchases through the Universal Service Funding mechanism (E-Rate). Sections of the law appear below: N.J.S.A. 40A:11-3Bid Threshold: period of contracts a. When the cost or price of any contract awarded by the contracting agent in the aggregate does not exceed in a contract year the total sum of $17,500, the contract may be awarded by a purchasing agent when so authorized by ordinance or resolution, as appropriate to the contracting unit, of the governing body of the contracting unit without public advertising for bids, except that the governing body of any contracting unit may adopt an ordinance or resolution to set a lower threshold for the receipt of public bids or the solitication of competitive quotations. If the purchasing agent is qualified pursuant to subsection b. of Section 9 of P.L. 1971, C. 198 (C. 40a:11-9), the governing body of the contracting unit may establish that the bid threshold may be up to $25,000. Such authorization may be granted for each contract or by a general delegation of the power to negotiate and award such contracts pursuant to this section. N.J.S.A. 40A:11-5Exceptions [to the bid threshold] Any contract the amount of which exceeds the bid threshold, may be negotiated and awarded by the governing body without public advertising for bids and bidding therefor and shall be awarded by resolution of the governing body if: (1) The subject matter thereof consists
