40:9A-1. Federation of city-county libraries

Any county or counties, municipality or municipalities, or any combination thereof, operating libraries pursuant to chapters 33 or 54 of Title 40 of the Revised Statutes may, by contract or agreement, by and between the appropriate board or boards of chosen freeholders and the municipality or municipalities, establish and maintain a federation of their libraries for the purpose of providing such co-operative library services as shall be thereby agreed upon.

40:9A-2. Costs; managemen

Such contracts shall set forth the proportion of the cost each party thereto shall assume and specify all the details of the management of the joint undertakings, and any other matters that may be deemed necessary for insertion therein, and may be amended from time to time by the contracting parties.

40:9A-3. Interlibrary loan services; free use by residents

Such contracts shall provide for the establishment of interlibrary loan services among the federated libraries and the free use for reference purposes of the library resources in the federation by any resident of the area served by the participating municipalities and counties.

40:9A-4. Standards for libraries

The State Librarian, subject to the approval of the President of Thomas Edison State College, shall formulate and promulgate standards for the said federations of libraries to insure the public convenience in the use of such library services.

SUBCHAPTER 1. STANDARDS FOR FEDERATION OF FREE PUBLIC LIBRARIES

15:20-1.1 Advisory council of federation of free public libraries; appointment; term

(a) Each federation shall have an advisory council appointed by the boards of trustees of the free public libraries of the municipalities constituting the federation and by the county library commission, if the county library is a participating member.

(b) Membership on the advisory council shall be restricted to the membership of the appointing authorities.

(c) The number of members on the advisory council and the apportionment among the appointing authorities shall be determined by agreement, except that there shall be at least one representative from each appointing authority.

(d) The term of each member of the advisory council shall be two years, or as determined by the appointing authority.

15:20-1.2 Duties of advisory council of federation of free public libraries

(a) The advisory council shall advise the appointing authorities on all matters relating to cooperative or joint library services, including the review of all contracts, and shall make recommendations revision or renewal as may be advisable and practical.

(b) Such recommendations shall be delivered to the appointing authorities at least three months before the fiscal year for which the proposed contract is designed.

15:20-1.3 Employees of federation of free public libraries

(a) The libraries maintained by the contracting parties shall employ an aggregate of at least one full-time employee, or the equivalent thereof in part-time employees, exclusive of security, custodial, and janitorial employees, for each 4,000 persons served by such libraries.

(b) At least one-third of the aggregate number of employees specified in (a) above shall hold professional librarians' certificates as specified in N.J.S.A. 45:8A-1 et seq.

15:20-1.4 Selection of books, specialization

Arrangement shall be made to provide for the cooperative selection of books and other library materials and for the cooperative specialization in the selection and retention of books and other library materials by the constituent libraries.

15:20-1.5 Other cooperative operations of federation of free public libraries

(a) Provision shall be made for any or all, but not fewer than two, of the following cooperative or joint services:

  1. Reciprocal borrowers' privileges;
  2. Centralized processing of books and other library materials;
  3. Centralized processing of books and other library materials;
  4. Uniform rules and procedures for the circulation of books and other library materials;
  5. Uniform rules and procedures for the registration of borrowers;
  6. The joint employment of personnel for specialized library services; and
  7. Other cooperative or joint library services comparable to any of the provisions listed above to insure the convenient use of the constituent libraries.

CHAPTER 7. COUNTY SUPERINTENDENTS OF SCHOOLS

18A:7-8. General powers and duties

Each county superintendent shall:

a. Visit and examine from time to time all of the schools under his general supervision and exercise general supervision over them in accordance with the rules prescribed from time to time by the state board;

b. Keep himself informed as to the management, methods of instruction and discipline and the courses of study and textbooks in use, the condition of the school libraries, and the condition of the real and personal property, particularly in respect to the construction, heating, ventilation and lighting of school buildings, in the local districts under his general supervision, and make recommendations in connection therewith;

c. Advise with and counsel the boards of education of the local districts under his general supervision and of any other district of the county when so requested, in relation to the performance of their duties;

d. Render a report to the commissioner annually on or before September 1, in the manner and form prescribed by him, of such matters relating to the schools under his jurisdiction as the commissioner shall require; and

e. Perform such other duties as shall be prescribed by law.

EDITORIAL NOTE

The following section of the "Quality Education Act" defines how foundation aid is determined for school districts. Note in paragraph b. that foundation aid may be used for school libraries.

CHAPTER 7D. QUALITY EDUCATION ACT

18A:7D-4. Determination of foundation aid

a. Each district's foundation aid for current expenses and capital outlay purposes shall be determined as follows:

A = MB - FS where
A is the foundation aid;
MB is the maximum foundation budget determined pursuant to section 6 of P.L.1990, c. 52 (C. 18A:7D-6);
FS is the district's local fair share determined pursuant to section 7 of P.L.1990, c. 52 (C. 18A:7D-7).

b. Each district's foundation aid for current expense and capital outlay shall be expended to provide a thorough and efficient system of education and may be used for preschool programs, full day kindergarten, school libraries, school security and other educational purposes and functions.

CHAPTER 32. COUNTY TEACHERS' LIBRARIES

18A:32-1. Appropriation for establishment and maintenance

Whenever in any county there shall have been raised by a subscription a sum of money not less than $100.00 for the establishment of a library of pedagogical books for the use of the teachers of the public schools, the director of the treasury shall, upon the order of the commissioner, draw his warrant on the state treasurer in favor of the county superintendent of the county for the sum of $100.00 for the benefit of such library. Annually thereafter there shall be paid on a like order a sum not less than $50.00 nor more than $100.00 upon condition that there shall have been raised by subscription a like sum for the maintenance of the library for the year.

18A:32-2. Committee to select books and manage library

The county superintendent and three teachers of public schools in the county appointed by him shall constitute a committee to select and purchase books and apparatus for the library, and to make rules for the management, use, and safekeeping thereof.

9:1-1.7 Off-campus offerings

(a) Off-campus offerings shall be considered part of the total program of the institution and shall be judged by the same criteria used for the sessions and courses offered by the institution or its main campus.

(b) The establishment of extension centers shall have prior approval of the Executive Director of the Commission on Higher Education. The establishment of branch campuses shall have prior approval of the New Jersey Commission on Higher Education. In requesting approval for Extension Centers and Branch Campuses, a formal request shall be submitted to the New Jersey Commission on Higher Education which shall include a statement justifying the need for the site and a description of proposed courses/programs. It shall also include evidence that the proposed courses/programs at the off-campus site are at least equivalent in quality to the comparable courses/programs on the main campus and that the institution has provided for effective monitoring and control for the maintenance of quality. Specifically, it shall include:

1. Evidence regarding the adequacy of classroom, laboratory, and library facilities.

(d) Off-campus sites at which credit courses are offered by a college in conjunction with or under contract with a non-collegiate organization must be approved by the Executive Director of the Commission on Higher Education regardless of the size or scope of the effort. If a complete degree, certificate, or diploma program is offered under such an arrangement, it must be handled under the same procedure as holds for any Branch Campus. The approval process will include a review of the college's adherence to the following standards:

6. The college shall insure that appropriate academic services are provided for students enrolled in such courses. These services shall include opportunities for access to library, laboratory facilities and computers, and advising.

9:1-1.9 Library

(a) Each institution shall formulate, adopt and implement a library policy adequate for the support of its mission, the range of its educational programs, and the needs of students and faculty. The statement shall define the size, nature, and scope of the library holdings, the nature of faculty involvement in the determination of library policy, and the extent to which the library is planned to be self-contained or to draw on other sources.

(b) The library shall be staffed by qualified professionals and support personnel in numbers sufficient to serve the needs of the students and faculty.

(c) There shall be annual acquisition of books, and other library materials.

(d) Study space and work space shall be provided to support the instructional strategies utilized.

(e) A two-year college with a library of fewer than 20,000 titles or a four-year college with a library of fewer than 50,000 titles is expected to justify the adequacy of the size of its holdings.

SUBCHAPTER 4. RULES FOR GRADUATE PROGRAMS WHEN CONDUCTING LICENSURE AND RELICENSURE REVIEWS

9:1-4.10 Facilities

The institution should have those facilities necessary for the attainment of the objectives of each program. These include adequate library study space for faculty and students, seminar rooms, office space for the faculty, provision for secretarial service as well as modern apparatus and instruments in those disciplines in which sophisticated activity demands them.

9:1-4.11 Library

(a) Beyond the needs of the undergraduate college, the graduate school shall have, for each program, a variety and depth of specialized material available on the campus.

(b) A library that supports a graduate program shall provide an adequate and current base for research activities. The library should provide books and other essential materials both in the fields of instruction and research and in related areas to serve as background material and, in much greater depth for special investigations.

SUBCHAPTER 5. RULES FOR PROPRIETARY INSTITUTIONS OF HIGHER EDUCATION IN NEW JERSEY

9:1-5.5 Minimum library requirements

a) A proprietary institution offering a degree shall have a library collection of sufficient size and composition to meet program objectives, to support high quality instruction and, where appropriate, research.

(b) The library collection shall be kept up-to-date.
