The Thirty-eighth Regiment was organized under the provisions of an Act of Congress, approved July 22, 1861, and an Act of Congress, approved July 4, 1864, as set forth in General Orders No. 224, dated War Department, Adjutant General's Office, Washington, D. C., July 6, 1864, and under authority received from the War Department for the raising of two regiments of Infantry, and promulgated in General Orders No. 4, dated Office of Adjutant General, Trenton, N. J., August 24, 1864. The Regiment was organized under the provisions of General Orders No. 110, War Department, Adjutant General's Office, Washington, D. C., April 29, 1863. Instructions were issued and recruiting for the Regiment immediately commenced. The Headquarters of the Regiment was established at Camp Bayard, Trenton, N. J., and active measures were put forth to complete the organization at an early day. The required number of men to complete the Regiment was raised and mustered into the service of the United States, by companies, for one year, by the 1st day of October, 1864. Company A was mustered in September 22; Company B, September 9; Company C, September 10; Company D, September 24; Company E, October 1; Company F, September 22; Company G, September 27; Company H, September 30; Company I, September 12; Company K, September 15, and Field and Staff, October 3, 1864, at Camp Bayard, Trenton, N. J., by George B. Eckert, First Lieutenant Third Infantry, United States Army. The Regiment was fully completed and organized by the 3d day of October, 1864, having a full complement of men. Officers, 38; Non-Commissioned Officers and Privates, 944. Total, 982. It left the State in three detachments. Companies B, C, I and K left September 20, 1864, under the command of Captain George W. Day; Companies F, D and A, September 29, 1864, under the command of Major William H. Tantum; Companies E, G and H, October 4, 1864, under the command of Colonel William J. Sewell. Each detachment under orders proceeded to Baltimore, Md.; thence by transports to City Point, Va. Upon arrival it was assigned to garrison and other duties, the headquarters of the Regiment being at Fort Powhattan, on the James river, having been assigned to a Provisional Brigade, Army of the James. It remained in this vicinity during its entire period of service. In the early part of 1865 the strength of the Regiment was increased by the joining from Draft Rendezvous, Trenton, N. J., of a number of Recruits. The Regiment continued its organization and remained in active service until the close of the war. It was mustered out of service at City Point, Va., June 30, 1865, by J. Remington, Captain and Assistant Commissary of Musters, Department of Virginia, by authority, as set forth in a telegram dated War Department, Adjutant General's Office, Washington, D. C., May 29, 1865, and started immediately on its return to New Jersey, where it arrived July 4, 1865.
The Regiment was attached to a Provisional Brigade, Army of the James.
The Regiment took part in the operations of the Army before Petersburg, Va., which resulted in its capture April 2, and the surrender of General Lee, April 9, 1865.
